Simple 3-step Process to Obtain a certificate of barrier compliance for pool and spa Owners

To assist you in obtaining a Pool or Spa Certificate of Barrier Compliance, Pool & Spa Safety Compliance, Victoria has developed a simple 3-step process. These steps are to ensure we can provide you with a service that is Professional, Effective and Efficient in obtaining your Certificate.

Barrier inspections

Once your swimming pool or spa has been registered, you need to arrange an inspection of the safety barrier to determine if the barrier is compliant with the applicable barrier standard.

An inspection of your pool or spa barrier can only be carried out by:

  • a registered building surveyor
  • a registered building inspector
  • a municipal building surveyor

Step 1. Register your pool or spa with council

  • Register or update your Pool or Spa detail with the relevant council.
  • Owners must register their Pool or Spa with Council before 1 November 2020. This includes Pools or Spas with a building permit. Once you register with the council, you do not have to register again.
  • If you own a Pool or Spa and Council has not contacted you, then you can register it online.
  • If you own a rental property that has a Pool or Spa, it is your responsibility to register by 1st November 2020. This also includes if the tenant has installed a Pool or Spa.
  • Owners who do not register their Pool and Spa by 1 November 2020 may incur an on-the-spot Fine, currently $332.31*^ or a penalty of up to $1,817.40^  
  • You can also update your details, including notifying Council that you don't own a Pool or Spa, or it's been filled-in / removed. You can declare it online or you can complete the Pool and Spa Registration Amendment form.

Please note: if you have a separately fenced Pool and a Spa you MUST Register them separately

Step 2. Book a Safety Barrier Inspection

Certificate of Barrier Compliance Inspection - Service & Fee

If your Pool or Spa Safety Barrier is Compliant at the first inspection, our service fee will only be $295.00 (gst Inclusive).No More to Pay.

This price includes, a Certificate of Barrier Compliance Inspection Report & (Form 23) - Pool / Spa Certificate of Barrier Compliance. The Certificate is to be lodged with the relevant Council within 30 days, from date of issue, with your next inspection due in four years’ time.

Prior to the four-year period ending, your Council will advise you to organise another mandatory inspection to ensure your Pool / Spa continues to be Compliant with the applicable standard set by Council, and we hope you will use our services again, to ensure your Pool and Spa Barrier meets safety standards.

Cost for this Service $295 includes GST

Compliance Consultation Inspection - Service & Fees:

This service is designed for owners who have their Certificate lodgment due soon and have reviewed the relevant checklist on our website under the resources tab and are still not confident that their Pool or Spa will achieve Compliance of the first inspection.

This Service is also for Owners looking to renovate or redevelop their property, which may affect their current Pool or Spa Barrier state of Compliance and need advice to ensure the changes they intend to make, will comply with the applicable standard set by Council.

We also provide this service for Real Estate Agents, Property Managers and Landlords wishing to obtain a Certificate of Compliance as part of their section 32 prior to selling and / or making sure their rental properties comply, during before or after tenancy.​

For the services detailed above, our service fee is $265.00 (gst inclusive). This price includes a detailed inspection report. The report includes photos and details of the items identified as non-Compliant with recommendations / solutions on how to rectify the items to achieve Compliance, as per the applicable standard applied Council.

To allow you to time to address these issues, you will be given a maximum of sixty days to achieve Compliance.  Pending to the nature of Non-Compliance issues, a mutually agreed date will be discussed to conduct a Mandatory Re-Inspection, see details below.

Pool or Spa Safety Barrier Compliance Inspection & Certificates

This detailed Inspection of your Pool or Spa Safety Barrier, will provide you with a Comprehensive assessment and subsequent report as to whether your Safety Barrier has been able to achieve or not achieve Compliance as per the relevant Australian Standards applied to Your Pool or Spa

  • Issuing a Compliance Certificate – Form 23  At the conclusion of the Pool or Spa Safety Barrier Inspection and we find that your Safety Barrier to be Compliant, with all aspects of the relevant Barrier Safety Standards. You’ll be issued with a Comprehensive Report detailing those finding and as such, you will be issued with a Pool or Spa Safety Barrier Compliance Certificate, Form – 23. Once received, you need to lodge this Compliance Certificate to the relevant Council, within 30 days from the date of the notice.

    However, if the initial Compliance Inspection identifies elements of the Safety Barrier which do not comply with the relevant Safety Standards, then a Certificate of Non-Compliance will be issued, see below:
  • Issuing a Non-Compliance Certificate – Form 24.  In order to meet the relevant standards, you will be advised what is required to rectify these items via a written report to assist you in achieving Compliance. In order to allow you to time to address these issues, you will be given a maximum of 60 days to achieve Compliance.  Pending on the nature of Non-Compliance issues, a mutually agreed date will be discussed to conduct a Mandatory Re-Inspection see Step 3.

Cost for this Service $375 includes GST.

Reminder Notice: As part of our service, we will also provide you with a notice, 6 months from when your next inspection will take place. In Victoria all Pool and Spas MUST be Inspected every 4 years, from your last Dated Compliance Certificate notice. This will give you ample time to allow you to prepare for your next Pool or Spa Safety Barrier Compliance Inspection.

Re-Inspection & Compliance Certificate - Service & Fee:

If your Pool / Spa is found to be non-Compliant during the initial Consultation Inspection, there will need to be a Mandatory re-inspection to ensure all items identified as non-Compliant, meets Compliance, as per the applicable standard set by Council.

Our service fee for the re-inspection will be $95.00 (gst Inclusive).Pending on the Pool / Spa Barrier achieves Compliance, this fee will also include a (Form 23) - Pool / Spa Certificate of Barrier Compliance. The Certificate is to be lodged with the relevant Council within 30 days, with your next mandatory inspection due in 4 years, from the date of the last Certificate.

Prior to the four-year period ending, your Council will advise you to organise another mandatory inspection to ensure your Pool / Spa continues to be Compliant with the applicable standard set by Council, and we hope you will use our services again to ensure Compliance is achieved.

Possible Council Fees, Notices or Orders

If your Pool / Spa Safety Barrier is non-Compliant and deemed as a high safety risk, for example the parts of the barrier are open allowing a person to access your Pool / Spa area, Council may issue fees, and other notices or orders under the Building Act 1993, see details on your local Council or VBA websites.

Step 3. Lodge Your Spa and Pool Safety Barrier Compliance Certificate to Council

Lodging Your Certificate: At the conclusion of the Pool or Spa Safety Barrier Inspection and we find, your Safety Barrier is Compliant, Pool & Spa Safety Compliance, Victoria, will issue you with a Safety Barrier Compliance Certificate, (Form 23).

Once received, Owners are required to Lodge this Certificate to your Council within 30 days, from date of issue. Failing to lodge on or before the issue date will result in another inspection.

 * Fees are set by the relevant council and will not exceed this amount. Please check the council's website for the fee that applies.
^ These fees and penalties are applicable until 30 June 2022

After Registration, What Happens Next?

Issuing a Compliance Certificate:  At the conclusion of the Pool or Spa Safety Barrier Inspection and we find, your Safety Barrier is Compliant, Pool & Spa Safety Compliance, Victoria, will issue you with a Safety Barrier Compliance Certificate, Form – 23.

  • When the pool or spa was built
  • Its Applicable Construction Standard
  • When Owners MUST Lodge a Certificate of Compliance with Council
