Municipal Building Surveyor may issue an improvement notice for Pool and Spa barriers. If the council receives a Certificate indicating that the barrier is non-Compliant with regulations. This type of notice is typically served for minor non-Compliance issues and outlines the necessary rectification works to make the Barrier Compliant, and the timeframe within which these changes must be implemented.
As of December 1, 2019,Victoria introduced new regulations aimed at improving the Safety of Swimming Pools and Spas. It has now become necessary for Owners with a Swimming Pool or Spa located on their property to register their Pool or Spa with the appropriate council.
Owners must also ensure an inspection of their Pool or Spa Safety Barriers, and subsequently, lodge a Certificate of Barrier Compliance with their council. If non-compliance items are identified during the initial inspection, it is the responsibility is on the Owner to rectify works required to achieve compliance.
The regulations are applicable to swimming pools and spas with a capacity to hold more than 300 mm (30 cm) of water. This includes Permanent Pools, Indoor Pools, Above Ground Pools, Hot Tubs, and certain types of relocatable Pools such as Inflatable, Bathing or Wading Pools.
Movable Pools that are simple in design, consisting of a single component and needing no assembly, are exempted from these barrier requirements. An example of such a product would be a small inflatable Pool that requires only inflation for assembly.
